Despite the FDA’s efforts to curb the influx of fruity-flavored vapes, thousands of unauthorized products continue to flood the U.S. market. Many companies are finding creative ways to navigate the regulatory landscape, including rebranding and circumventing bans.

Take the case of Pastel Cartel, the Austin, Texas-based company behind a wildly popular disposable vape line. Before the FDA’s recent crackdown, the brand had amassed over $240 million in sales. However, a ban on their Chinese imports last month dealt a significant blow to their operations.

Pastel Cartel’s CEO, Darrell Suriff, insists his company has gone above and beyond to comply with FDA regulations. According to Suriff, the company invested a staggering $8 million in a comprehensive application to secure FDA approval, only to have it rejected. Now, he’s challenging the decision, appealing the application rejection, and exploring options to overturn the import ban.

This ongoing tug-of-war highlights the complexities of regulating the rapidly evolving vape industry. While regulators work to protect public health, companies like Pastel Cartel continue to push back, adapting and fighting to remain competitive in a market that shows no signs of slowing down.
